Welcome to Kimi K2, an advanced AI chat assistant powered by a trillion-parameter MoE model. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

Kimi K2 provides users with:

• AI-powered chat assistance with 128K context window
• API access for developers to integrate AI capabilities
• Credit-based usage system
• Guest access with limited free messages

You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

1. Account Creation:

   • Guest users can access 10 free messages without registration
   • Creating an account grants 100 free credits
   • Accounts can be created using Google or GitHub authentication

2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activities that occur under your account.

3. API Keys: If you generate API keys, you must keep them secure and not share them publicly. You can revoke API keys at any time through your dashboard.

Credits and Usage

1. Credit System:

   • Each conversation message consumes 1 credit
   • New users receive 100 credits upon registration
   • Additional credits can be purchased through our pricing plans
   • Referral rewards: 50 credits for new user signups, 500 credits for paid conversions

2. Guest Limitations:

   • 10 free messages without login
   • Session data stored locally and may be cleared after 30 days

3. API Usage:

   • Subject to rate limits based on your plan
   • Usage tracked for billing and analytics purposes

Content and Intellectual Property Rights

1. Kimi K2 Technology: The core Kimi K2 model, infrastructure, and service are owned by kimi-k2.ai. The model weights are open-source under applicable licenses.

2. Your Content:

   • You retain ownership of all content you submit to Kimi K2
   • Your conversations are NOT used to train our models
   • You can delete your data at any time

3. AI-Generated Content:

   • Content generated by Kimi K2 is provided for your use
   • You are responsible for reviewing and verifying AI-generated content
   • Do not rely solely on AI output for critical decisions

Prohibited Activities

You agree not to:

• Use the service for any illegal, harmful, or malicious purposes
• Attempt to jailbreak, manipulate, or abuse the AI model
• Generate content that violates laws or third-party rights
• Reverse engineer or attempt to extract the model weights (except for open-source versions)
• Share or sell your account credentials or API keys
• Use automated systems to abuse the free tier or credit system
• Interfere with or disrupt the service or servers
• Use the service to create competing AI services without authorization

Privacy and Data Protection

• We do not train on your data
• Conversations are encrypted during transmission
• You can delete your data anytime

Pricing and Payments

1. Credit Purchases:

   • All credit purchases are final and non-refundable
   • Credits do not expire while your account is active
   • Prices may change with notice

2. Subscription Plans:

   • Billed according to selected plan (monthly/annual)
   • Auto-renewal unless cancelled
   • Cancellation takes effect at the end of billing period

3. API Usage:

   • Pay-as-you-go or subscription-based pricing
   • Usage beyond plan limits incurs additional charges

Service Availability and Limitations

1. Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted service

2. Model Limitations:

   • Kimi K2 may produce incorrect or biased outputs
   • Not suitable for medical, legal, or financial advice
   • Context window limited to 128K tokens

3. Rate Limits: API and chat usage subject to rate limits to ensure fair access

Termination

1. By You: You may terminate your account at any time through account settings

2. By Us: We may suspend or terminate accounts that:

   • Violate these terms
   • Engage in abusive behavior
   • Attempt to harm the service or other users

3. Effect: Upon termination, access to the service ceases immediately. You may export your data before termination.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE MAKE NO WARRANTIES ABOUT:

• The accuracy or reliability of AI outputs
• Uninterrupted or error-free service
• Fitness for any particular purpose

Limitation of Liability

To the maximum extent permitted by law, kimi-k2.ai shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount you paid us in the past 12 months

Indemnification

You agree to indemnify and hold harmless kimi-k2.ai from any claims arising from:

• Your use of the service
• Your violation of these terms
• Your violation of any third-party rights
• Content you generate using the service

Modifications to Service

We may:

• Update model capabilities and features
• Change pricing with 30 days notice
• Modify API endpoints with documentation updates
• Discontinue features with reasonable notice

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which kimi-k2.ai operates, without regard to conflict of law provisions.
